These apply to the sale of all of Inspired Artists’ products, as feature on this site, to its Customers. All Products can be either received by a Customer on their mobile handset directly or sent them as an e-mail attachment.
Products are offered at a price advertised on this site and do not include any call costs that may be applied by your mobile network operator in order for you to receive the Products directly to your mobile handset. The call costs are fixed by your mobile network operator and you should contact them to get the current prices.
Warnings
All the performers on this web site are highly trained professionals. None of the featured tricks should be attempted by anyone without proper instruction, training and professional supervision. Doing so could result in serious injury or even death to those involved.
All customers must be aged 16 or over and must obtain permission from the bill payer before ordering.
The video clips are in 3GP format that is compatible with all 3G enabled mobile phones and many others. All other clips are in either in JPG or GIF format.
Please understand that the ability to receive text messages on a mobile phone does not necessarily mean that you will be able to receive our Products, or that you phone can handle these formats. The Customer must therefore ensure that the phone to be used is compatible with our products before ordering them.
When Ordering Products for Download Straight to a Mobile Phone
The Customer will need to have a mobile phone with a current service and MUST HAVE both text messages AND web browsing enabled on it. It is ESSENTIAL that if the receiving phone is TURNED ON, the phone's memory is NOT FULL or near to its upper limit, and that the phone is not outside the Customer’s network area.
When Ordering Products for Download to a Mobile Phone via an e-mail address
The Customer will need to have a valid e-mail account with sufficient free space to receive our message. The Products will be sent as attachments to the e-mail in the formats specified above. The Customer can then upload the Products to their mobile phone using his/her own equipment.
Delivery
We will endeavour to deliver the Products to Customers as quickly as possible. If Customers do not receive their chosen Product within 48 hours, they should contact Inspired Tricks by e-mail, quoting the relevant order number.
Before paying for our Products, the Customer will be asked to provide a mobile telephone number and/or an e-mail address to which our Products will be sent. It is the Customer’s responsibility to ensure that the mobile phone numbers and/or e-mail addresses are capable of receiving our Products. We cannot subsequently re-send the Products to other mobile phone numbers or e-mail addresses.
Inspired Artists will then either:
Send an e-mail containing the Products as attachments to the specified e-mail address within 24 hours of receiving confirmation that your payment has been successfully processed. Please allow up to 48 hours for arrival of the Products as this is also dependent on your service provider.
Send the Product direct to your mobile phone within 24 hours of receiving confirmation that your payment has been successfully processed. Please allow up to 48 hours for arrival of the Products as this is also dependent on your service provider.
Royalties are paid to our Artists according to the number of Products sold. Inspired Artists Limited grants the Customer, or the owner of the mobile phone to which our Products have been downloaded, non-transferrable license to use our Products as downloaded for their personal use. The Customer may not reproduce, modify, perform, transfer, distribute, sell, resell, create derivative works of, exploit for any commercial purposes, or otherwise use or make available our Products, except as expressly provided in this Agreement. The copy or transfer of our Products for group or commercial use is not authorised since it deprives our artists of their rightful income as well as depriving us of resources to produce new Products and support new artists.
Privacy of Customers’ Details
Inspired Artists will not keep any personal information regarding to their customers. Any personal information provided to other parties, such as PayPal, during the processing of their payments will used and retained by them according to the Terms of Use of their services which can be found on their web sites.
Refunds
Refunds will be made only if we determine that it is impossible for the Customer to use the Product, and if the Customer can prove that he/she has respected all the pre-requisites specified above to receiving the Product. We will then provide the refund within one month of receiving the Customer's itemised phone bill figuring the call concerning the attempted download.
No refund will be made if :
the Customer orders a product and his/her phone cannot handle our specified formats
incorrect mobile and/or e-mail details are given
the Customer has chosen e-mail delivery, but has not made sure that his/her e-mail account is active and has sufficient free space to receive the Products or that his/her equipment can transfer the Products in the specified format to his/her mobile phone.
Warranty
Subject to applicable regulatory provisions, Inspired Artists ’s products are provided "as is", and access to them depends on their availability. We reserve the right to add and remove Products from our web site at any time.
The risk of using our Products is assumed by the Customer, under their full responsibility. Inspired Artists cannot guarantee that the products will fully meet the Customer's expectations.
In no event shall Inspired Artists be held liable for any damage to the Customer’s computer or mobile phone, or loss of data on these devices and associated peripherals. Advice or information, either written or verbal, obtained by the Customer from inspired Artists cannot be construed as a warranty of any kind if it has not been explicitly provided for in these terms.
Under no circumstances shall Inspired Artists be liable for any direct, indirect, incidental, third party or consequential damages resulting from the use or the impossibility of use of the Products.
All these provisions are subject to English law. In the event of a dispute, the English courts shall have sole jurisdiction.
